Terms of Service

SakayKo is in public beta. These Terms apply to your use of the Service during the beta period and will remain in force after launch unless updated. We'll notify users in-app of any material change.
1. Acceptance of Terms
By creating an account or using the SakayKo mobile application or related services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. About SakayKo
The Service is built and operated by CypherZero.dev, a technology studio creating tools for communities across the Philippines. SakayKo is a technology platform that connects passengers and senders with independent transport providers ("Drivers") for ride-hailing, errand running ("Pabili"), and parcel delivery ("Padala") services on Bantayan Island, Cebu, Philippines.
SakayKo is not a transportation provider. We do not own vehicles, employ drivers, or directly perform transport services. Drivers are independent contractors.
3. Eligibility
- You must be at least 18 years old (or have parental consent if 13–17) to create an account.
- You must provide accurate registration information (name, phone number, etc.).
- You must have legal capacity to enter into binding agreements.
4. Account Registration & Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@cypherzero.dev if you suspect unauthorized use.
5. Booking & Fares
SakayKo uses an offer-and-counter pricing model. When you create a booking, you state a fare you are willing to pay. Drivers may accept your offer or send a counter-offer. You may accept any counter-offer, wait for another driver, or cancel the booking. The agreed fare becomes final once a driver is accepted.
Payment is made directly in cash to the Driver upon completion of the booking. SakayKo currently does not process payments and does not take a per-ride commission during the beta period.
6. Cancellations & Reassignment
Either party may cancel a pending or accepted booking. If a Driver cancels an accepted booking, SakayKo will automatically reopen the booking so another Driver can accept it, and a local dispatcher may manually assist if needed. Repeated unjustified cancellations by either party may lead to account suspension. Because payment is cash on arrival, refunds are not handled by SakayKo — disputes should be resolved directly with the Driver, with our support team's help if needed.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose, including transport of illegal goods.
- Harass, threaten, or harm Drivers, other passengers, or our staff.
- Attempt to defraud the Service (fake bookings, off-app payment diversion, chargebacks, etc.).
- Reverse-engineer, scrape, or interfere with the app's operation.
- Use the Service while intoxicated to a degree that endangers others.
8. Driver Responsibilities
Drivers are independent contractors and must hold valid licenses, registrations, and insurance applicable to their vehicle type under Philippine law (LTO, LTFRB, local ordinances). SakayKo verifies basic driver identity and vehicle information during onboarding but is not liable for a Driver's ongoing regulatory compliance.
9. Ratings & Reputation
Both passengers and Drivers may rate each other after a completed booking. Ratings help maintain service quality. SakayKo reserves the right to suspend or remove accounts that consistently violate these Terms or receive substantiated abuse reports.
10. Limitation of Liability
To the maximum extent permitted by Philippine law, SakayKo and CypherZero.dev, including our officers, employees, and contractors, are not liable for indirect, incidental, or consequential damages arising from your use of the Service, from interactions with Drivers or other users, or from the acts or omissions of independent Drivers. We do not warrant that the Service will be uninterrupted or error-free.
11. Indemnification
You agree to indemnify and hold harmless SakayKo and CypherZero.dev from claims arising out of your violation of these Terms or your interactions with Drivers and other users.
12. Termination
We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time from the app's profile screen, or by emailing support@cypherzero.dev.
13. Changes to Terms
We may update these Terms from time to time. Material changes will be announced in-app and on this page, with the "Last updated" date above. Continued use after changes constitutes acceptance.
14. Governing Law
These Terms are governed by the laws of the Republic of the Philippines. Disputes shall be resolved in the courts of Cebu City.
